I posted awhile back about the chimney fire at the new house I bought. I've exhausted all of my resources fixing the damage from this and am still short a few thousand. So some of my toys are going. See my ad in the classifieds and help a brother out. I am holding on to my shell as I am in the middle of a conversion on it but my '72 driver has to go. So do my custom Peavey amps, my PA system, atleast one of my custom guitars, basically all my toys. The insurance company says the damage to the chimney, flue and house were all caused by the chimney fire but it was pre-existing to the sale of the house to us.

Any ways in short the toys gotta go and I'm barely being allowed to keep the shell.

Was the house pre-inspected prior to your purchase? It seems like a non-disclosed or pre-existing condition that can cause something as bad as a fire should be covered by some kind of insurance.

Too bad that you have to sell off some nice things for this.

House inspection didn't reveal the damaged flue. The sellers disclosed that they had not cleaned the chimneys in 12 years. As part of the P&S I asked that they not only have the chimneys cleand but inspected as well. I don't recall receiving a copy of teh inspection but according to the engineer that inspected last week the damage is significant enough that it is unusable. Sounds to me like the damn PO hid that fact from us. My only recourse will be thru a lawyer. By nature I am not a litigious person and believe the courts are over used for BS cases. We'll see how it plays out. In the mean time I need to get the work done and get into the house.

Having been through this recently, I have learned that it is really important to order your own inspections. You have to pay for them, but it is really worth the money. I had a separate set of inspections on my current place cuz i kinda got screwed like this on my last one.

A good realtor will even recommend that both cuz its a good idea and it covers their butt as well.

Sue his ass off! Really! Call the realtor and tell them to put their errors and omissions carrier on notice! You may not have to even call a lawyer.

here is an option that might let you keep a few more toys or maybe just the 914.... go get a short term personal loan to fix the house, lets say 6 k or about what you might get for the 914. then when you do your taxes you have a fire loss of what ever you put in to the house and your tax refund should pay the loan off.

my house burned a few years ago and i was a renter with out insurance, i got a nice tax refund from it.

btw the irs changed regs a few years back, they now have to prove that what you say you lost you did not have not, you have to prove you had it, so simply put that brand new 2000 dollars mattress that got ruined and the brand new wall to wall carpet that cost 4 grand that the firefighters ruined you can get back ( or at least before tax dollars ), just save pics of everything that got ruined .... cant tell the difference on the pic between 10 year old carpet and new stuff
