driving home from getting dinner,in my dodge shadow, bout 20 feet from my driveway and bike cops pull me over because third , auxilliary , brakelight is out. first they zoomed up on me and acted like they were going to pass on both sides- like some little gangbangers are doin these days ( no way to tell its a cop bike in the rearview ) then pull me over just to let me know the brake lights out.then he figures he may as well run my id while hes at it- turns out the $135.00 i just paid DMV hasnt cleared and they get back im driving on suspended license. no idea how it works in other areas but here this is a officer discretion call. so the prick has my car towed , says its just for overnight and you can get it out in mornin, oh yeah , plus youll have to pay a $400.00 fee. screw that only paid that much for the whole car and the trans is going out on it anyways ( no 3rd or reverse)

on my street alone in last 5 days ive seen about 12-15 people getting pulled over for no reason or for minimal reasons - all by the motorcycle cops in this police district

what REALLY pissed me off tho is them acting agressive while riding behind me, acting like they were gonna buzz past me on both sides , THEN pulling me over for a fix it ticket and instead of just doing what he said he was doing , which was in his words " i just pulled you over to let you know your third brake light was out so you could get it fixed" he pulls this shit ..ok mad rant off now heheh


so basically tomorrow or friday im filing a complaint against the officer, the police dept and possibly the city as well because all 3 are inter-involved in this type of action, which constitutes harassment by the police dept.

basically im going after this pissants badge, would love to meet up with this little POS in a dark alley sometime ............................

Seems like I am always hearing about controversy in that department on the local news.
How about the Sgt. that drove to the chiefs house and killed himself parked out front. If that isn't an indication of troubles I don't know what is.

yea cop said that all lights on a vehicle have to be working including auxialliary lights- also the 3rd brake light on this car doesnt light up when turn signals are blinkung and he only saw it "not working" when i was turning , so it wasnt lit when my signal was on- and yea im fighting it - no matter that i was unknowingly driving on a suspended license , he had no legit reason for stopping me in the first place

anyone know the VC part that says auz lights have to be working , and know whether or not quotas are legal or not?

One good reason to not move to CA as it seems the police there are annally intensive.

Thye got to keep their stats high so they can better justify there stress levels when they crack the next guy over the head for less than justifyable reasons while a video tape is running.

I agree - cops suck - so few these days give warnings.

I have less and less tolerance for government employees every day - and beaurucrats - don't get me started.

cops = revenue

courts especially = court fee revenue

Quotas are unlawful, and in 17 years I've never seen them. Motor Officers eat their young, and many say if you stop them you write them. Patrol Officers use minor equipment offenses as probable cause to look for bigger offenses. Last year I located a murder suspect and a carload of guys who had abducted, raped and beat a girl repeatedly. They were looking for a place to dump her. Both were from simple traffic stops.

Driving on a suspended license is a misdemeanor, similar to DUI. Some counties book violators into custody and some release on promise to appear. I don't know your county, but it's probably not a traffic citation, meaning you will have to appear in court and you can get a public defender to help you with your defense. Driving on a suspended license is similar to contempt of court only in this case it’s contempt of DMV. You should have been served with notice of the suspension. Notice can be in writing (with a return to DMV), and/or personal notice from a Judge, DMV or police officer. When your license was run in the computer, your DMV record states whether DMV has proof of service on file.

You can request a hearing to contest the tow on your vehicle. If you received a piece of paper showing where your vehicle was towed the information should be on the back. The hearing officer can only look at the legality of the tow. Many agencies have written policies requiring tows on unlicensed/suspended drivers. It only took one suspended driver getting back in his car and killing a family. The agency got sued, and there goes the discretion.

The issuing agencies receive a relatively small portion of traffic fines, and from my perspective they are not revenue generating. Parking tickets (if the offense is a muni code) have a much higher percentage. My agency issues about 5 warnings to every citation.

Please don’t shoot the messenger. I’m sorry you have to go through this. I wrote my first ticket of the year tonight and hated every minute, but a red light is a red light. Good luck.

This all stems from the "broken windows" philosophy of law enforcement and it has proven effective. Basically, like the previous poster had posted, they look for minor infractions and those lead to real crimes. This philosophy is what helped clean up NYC, so it does work. The problem is that sometimes people like you get caught up in it as well. In otherwords, please don't blame the officer.

Also, there is a ton of information on the Internet on how to beat tickets. Most of the steps are procedural and you have to make fillings with the court that require specific formats, etc... Also, if you have use of a public defender, use them too.

Yeah, that's the theory the new police chief brought to this town a few years ago. All the cops are writing speeding tickets while murder and robbery rates skyrocket...

There is a not so subtle message in what is written. A better, but perhaps not an indicative choice, would have been to write "and those COULD lead to real crimes." I hear law enforcement use this type analogy very often, but there's always an undertone of selectivity to a situation. These guys have a very difficult job (one that I would never want), and I always hope the majority provide a true public service to the community. Get stuck in a room full of officers (on or off duty) unfortunately challenges that perspective.

Unless it has been recently changed, Calinazifornia law is that you can drive on your license while your fees are in the mail and being processed. I suggest you look up that exact law or rule (I believe it is printed on the license renewal forms) and write a letter to the chief of police, and cc the City Council.

Demand your car back, no fees, and demand $5000 damages, and file a formal complaint agiasnt the Police asking for compensation (you have six months limit to file a complaint for money aginst a government agency.

i believe this cop is dead wrong, so look up the law and show it to them, you may still have to fight it, I stopped the Redwood City PD from running an illegal tickect operation, a ticket operation that they knew was illegal, yet continued to do it, and then finally stopped when I took them to court. yet a few months later they were at it again! One call to the captian and it stopped real quick, once I threatened the press on them (and by then I had the goods on them in writting and phone recordings admitting they were wrong!.

So don't be discouraged if they a first deny you are right, even when shown the law. The cops I have found are more interested in pleasing their masters (the politicians) than being honest civil servants. This is a great example of that.

Please keep us posted on how this unfolds, the cops reply , etc.....

Twice in as many months we have had cops pull bad shit , first on Mr. Mueller now on you. Lets see, the government takes half of what you earn, has crooked "law" officers and uses extortion to increase revenue.

Uhm. Time for a change i say. Throw the bums out!

I'd like to add a bit to this discussion from a slightly different perspective, that of being in law enforcement for 11 years (left in 1987). I don't doubt that there are bad cops/departments out there, who view tickets as a revenue tool, I've known a few personally over they years, but I've also known many honest, hard working cops who try to do a good job.

There can be many reasons to be pulled over, from the obvious (speeding, running a light, reckless driving, etc) to judgement calls (driving "erratic", equipment problems like burned out lights, matching the description of a wanted vehicle), to outright annoying (teen drivers in fast car, bright red sports car, etc). Many years ago, I was pulled over 3 times in three days without the reason being explained well. After the third time, I pulled my own shield and asked for a reason....the car I was driving was a dead ringer for one wanted in a shooting.

Being a cop is not an easy job. The car he pulls over may just be a mom who didn't properly stop at a stopsign, or the driver could be an armed drug dealer or wanted felon. The officer does not know (assuming the plate check comes back negative) until he gets to the car. And he'll probably err on the side of caution, but there is no excuse for being outright nasty. From my own experience, unless the driver did something real dumb, he had a 50/50 chance of a warning, rather than a ticket....and that often depended on the driver's attitude.

I know that being pulled over is a pain, but in the years since I was a cop, any time I have been pulled over (there have been a few :-), I did deserve it. If you're caught with your hand in the cookie jar, accept responsibility.
