so i got that set of 96mm cylinders today...
the box they shipped in was the first red flag.. (a "Flavor House, Inc." a spice company) I open the box and want to look at what they look like... I see padding on top (just the top mind you... their box is in it with some inflated air bubbles on top..) ... second red flag.. I open their box (it actually says their company now (qsc Quality Specialty Components.. yea right) I unwrap one cylinder, which basically had 2 layers of cardboard protecting it during shipping... this was apparent as a piece of one of the cylinder fins falls off upon completely unwrapping... im just like.. "wtf... 1. quality my ass 2. wtf... 3. now how do i fix this... i can tell this may turn into a struggle getting a refund/new one... so basically, qscusa.com friggin BLOWS! in my defense, they were bought on ebay and there was no mention of their company name or website... only upon seeing the website on the box is when I knew i had fuched up... wish me luck... EDIT: 4-14-08 - Received damaged product / 6:48pm - submitted question to seller through ebay reporting the broken item and requesting their return policy EDIT: 10:57pm - Sir, we can exchange the bad cylinder for a good one and ship the offending one back to us. Please ensure it gets back to us so that we can return for credit. - foreignparts_plus I emailed back asking if they will cover return shipping. EDIT: 11:44 - Yes, we will file a shipping claim for the damage. - foreignparts_plus EDIT: 11:45pm - I send: ah ok! Do ya'll ship the new one and I ship the old one back in the same shipping material or how does it work? - sanantoniobidder EDIT: 01:15am - That will be fine. - foreignparts_plus stay tuned.. |

I'm no attorney, so don't move forward on my comments, but;
1. You have received your money back on the items. 2. Although PayPal refunded you the purchase price, they did not provide any findings beyond that fact. 3. When you accepted the payment back from PayPal, you no longer had any legal title or claim to the items in question. 4. If you sell the cylinders, then you might be considered to have been enriched at the expense of the original seller. 5. At this time, the ownership of the cylinders never transferred to you, they are owned by the original seller. My advise is to check with PayPal regarding final disposition of these items. Additionally, I would send a registered letter (receipt required) through the U.S. mail to the sellers stating your desire to dispose of these items within 60 days of receipt of the letter, and that continued storage at your address after 60 days will result in storage fees being charged. Provide a copy of this letter to PayPal legal department. Keep copies of every communication regarding this transaction. Make notes of any telephone conversations you have including dates and names of persons in the conversations. I will be interested in hearing what the PayPal legal department has to say.
