It says "street legal". Don't most states require fenders? I believe it's just to prevent the 10' rooster tails you'd throw when driven in the rain.

Wouldn't be street legal in California but can be made so with GT flares (IMG:style_emoticons/default/welder.gif) .

Florida you don't need fenders just a windshield I think. Buggies are street legal.
