Tomorrow I finally get to go to court on the ba$tard that wrecked my taildragger april last year
He's refused to pay any damages and to top it off is spreading lies and BS claims...

It's only a prelimanary hearing, but some luck wouldn't harm me (I have very little trust in the legal system)
I just hope I can stay calm an not rip the a$$hole's head of when I see him in court

Hopefully I have some good news to report tomorrow...

Best of luck to you. Take a big breath when you first see him. Follow him out of the building and trip going down the steps and stop your fall by hitting him in the back. thus he gets your momentum and takes the bad fall and you stand there looking like Whoops did I do that lol2.gif

When it first happened it sounded like it was going to go much better than this, sorry to hear that it didn't. Good luck and don't forget to add in the cost of replacing your wet shoes!

Good luck man. Hope it all goes well. I'd be so pissed if someone wrecked one of my cars... I'm still trying to get the money off the city bus that sideswiped our Subie, so I know where you're at. That was a fender dent though - not a write-off!

A "tail-dragger" is a car with its engine in the second-best location. That is, at the back and not in the middle.

I.e., a 911.

The guy was a friendly neighbour (with emphasis on WAS)
He lives 3 doors down the street
Very shortly after the accident, he weasled out and refused to pay for damages

Good luck Jeroen, courts suck as a rule but generally they're better than having none at all....too many gunfights that way, if he was driving of his own volition, it should be a slam dunk.

Best of luck. As has been said before, stay calm, let the other guy get all pissy. That way the Judge thinks you're the reasonable one, and he's the jerk. In other words, the way it really is. smile.gif

Awe, a tail dragger, like my ghia or bug. I was thinking like a tail dragger air plane, ie tail landing wheel, verse a tricycle landing gear (nose wheel) Most tail draggers these days are light planes (although many light planes are tricycle gear) A large plane that is still flying, but a tail dragger would be the DC-3, all modern airliners use tricycle gear.

Good grief, I am at 40,000 feet, going 500 mph, and you're going to land this jumbo jet on tricyle landing gear, hell last time I was on a trycycle was when I was in first grade!

Anyway, hope you win,a nd your very nice looking 911 is repaired right.

Here's a twist, say he car jacked your 911, and you want him arrested for theft!!!!

Sorry, the whole episode stinks and the loss of the Red 911 still brings a tear to my eye. That was a kewl car! Atleast I got to ride in it going ready fast between the speedtrap cameras!

Best of luck, you deserve a break in this situation. Your neighbour should not be allowed to ride/drive anything but a tricycle.

thanks for all the support, last couple of days haven't been easy emotionally (lots of cropped up anger)

court date went reasonly well... I'm not getting exited about anything yet though...

lot more bs claims and reports from my friendly neighbour, playing all innocent that he didn't do anything crazy and that the car was "dangerous" and he didn't know about it

I tried to convince the judge the best I could that there are no dangerous cars, just dangerous drivers

Next the point of the value of the car came up... He had a statement from a friend who sells used cars, that my car was worth about 12 to 13K.
I had a written statement from my mechanic (who is the owner of an independent p-shop), who did ALL the maintanance on my car for the past 6 years with a value of 24K
Ofcourse my friendly neighbour claimed this guy didn't know shit and his friend (who has never seen or knows anything about my car) knows better screwy.gif

Next the judge offers us a chance to "settle"
He comes with a BS offer of 10K finger.gif

The judge said we ware both accountable for the accident (me because I let him drive), but he didn't say who is accountable for how much...

Next, an expert will be apointed by court to appraise the car
I don't fear that... I have bill of each and every service/part the car got since 1997 (when I bought the car) totalling up to 20K (that's just service and parts, not the car itself)

Next court date is set for august 24th

If anything, I learned I really NEED to finish the 914...
Right now, I feel I have no way to unwind any of this crap and it's eating me from the inside
A good spirited drive would do me wonders

What did the insurance company say? Don't they define fault by driver, not car?

Anyway, good luck on getting compensated. Sad that a "good" neighbor turns bad when trying to avoid responsibility for his own actions...

Sounds like things are going in the right direction. The judge didn't say NO !!!!....settle for your neighbor.

Kill the puke dead, and the dumb assed judge needs a bullet thru the head! Blaming the passenger for the wreck? what does he think you did, grab the wheel or something?

Did you have insurance? I assume not, cause you are fighting him over the car. With insurance, shouldn't they just pay for the wreck, regardless of the driver, minus any deducatble. The deductable can be gotten from the driver in court one would think.

At least that is how it generally would work here in America.

When you go to court again, bring with you at least three high estimates for your car's value. Have it all documented. Having recipts for the parts and work may not be enought to recover full value, as the car in the eyes of the judge is "used" but still with three good estimates, you ought to be able to beat that fucking nieghbors claim dead flat.

You job now is to get them estimates, no less than three, three is the number, and the number shall be three, not one nor two, but three, niether will 2 and a half will work, the number is three. (opps, a little tangent here, drugs do that.)

If the puke driver says it is your fault, or partial fault, file a lawsuit for slander! You ain't a bad driver, he can't get away with saying it is your fault.

One thing to remember, justice is sometimes not just, it is fucked. Revenge is also fucked, but only fucked for the person that is revenged upon, go get 'em.

These cars can be expensive to repair. Whenever I drive my 911, I run the risk of a missed shift that might cost me $3,000 in transmission rebuilding or $8,000 in engine rebuilding if there is an overrev.

Does this risk transfer automatically to a friend or is this the risk the owner runs regardless of who drives?

At a PCA driving school, do you let an instructor drive your car? Is an instructor going to write you a check for a missed shift while they are showing you how it's done?

Wow, I heard the latest is that it was a porno movie ring and she was slipped some drugs and died from that. Those "party beaches" aren't as safe as MTV shows especially at 2AM. Heck, Seattle's bars aren't safe for a girl at 2AM.
