(There had been some previous discussion on this board regarding some false and defamatory rumors aimed at the Barrett-Jackson auto auction. I wanted to post this press release that came out this morning that is related to that matter).


BARRETT-JACKSON SUES TO HALT DEFAMATION
SCOTTSDALE, ARIZ. MARCH 16, 2007 - Late yesterday Barrett-Jackson Auction Co. LLC filed suit in U.S. District Court in relation to a situation that occurred at the company’s January 2007 Scottsdale event. A consignor, apparently unhappy with the $300,000 sale price of his vehicle, placed chains and locks on the vehicle after it crossed the auction block and was sold, while it sat in the area where featured auction cars were displayed. He posted multiple notices on the vehicle claiming that the sale was void due to claimed "auction irregularities," and published other false and defamatory statements about Barrett-Jackson in view of the company’s customers and the thousands of patrons attending the event. Barrett-Jackson’s internal legal and security teams, and the Scottsdale Police Department, responded to the incident and documented the damage.
An ongoing internet smear campaign has stemmed from this seller dispute, with numerous defamatory rumors and untrue statements being published to websites and online chat rooms viewed by the company’s core customer base. In particular, an untrue, derogatory and defamatory “article” referring to the above incident has made its way onto more than 20 automotive-related online “blogs” and discussion boards frequented by thousands of classic car enthusiasts around the world.
Barrett-Jackson filed its lawsuit in order to protect its 36-year reputation and business interests by seeking to correct the untrue information that has been published, and by filing suit against the responsible party on six separate counts, including defamation and breach of contract.
Barrett-Jackson constantly strives to maintain the utmost ethical standards in all the company’s operations and activities. The company recognizes that not every customer will be happy with the result of every auction sale, and the Barrett-Jackson team values thoughtful, well-informed feedback. However, Barrett-Jackson takes the company’s business reputation very seriously, and will do whatever is necessary to defend against unfounded claims.

The man apparently works for them, and is putting out "their side" in a similar fashion as the seller. He searches for someone dissing BJ, then posts reply. He has two posts there, first one where he found the discussion, second where he posted this boilerplate. Saw it at the other site, can I say 914club here without getting my hands nailed to the desk? Can't say 914world over there, which seems a bit juvenile, but they defend the policy pretty strongly.

I know nothing of this incident, but something about their policies. I suspect what happened is he wanted a reserve price, they assured him he would sell his car for mega bucks and when the car was selling at a low price, they, or their agent, snapped it up at a bargain price for later resale. Not the first time, not the last. People are just plain stupid to do business with them, though I suppose if you have a car you think someone will pay too much for after 6 or 8 complimentary martinis, go right ahead.

Robby is associated with a PR firm in Scottsdale that lists BJ as one of its clients.

...so he works for them, as I said. He also posted what in effect is a demand to cease and desist in the thread that drew him to the club site on threat of lawsuit against the web site. Here is my side, if you don't come around to my way of thinking we will sue your ass.

Not that I ever thought about having any dealings with B-J, now I am convinced they are as shady as they appear to be. I will say the same thing as the boys who write South Park when confronted by the "Church" of Scientology, go ahead, sue me. Trouble is, they threaten to sue the website, sorry if I got you sued guys, you should win it on freedom of speech argument though, if that is any consolation.

Did I get this correct? A seller doesn't put a reserve on the car complains after the fact? How many of us would sell our cars without knowing the price? I can't imagine the seller not having ample time to reconsider his agreement.

Does anyone know what the market value of the car?

Sellers that give a car to an auction house to sell at no reserve can bid on the car themselves. They will end up paying for the car, and the buyers and sellers premiums.
It would seem to me to be a better way to go than end up in a lawsuit.
Appears that this was a very uneducated seller. Due dillegence, or have someone else take it to auction for you.

I agree, pay the fee to Barrett Jackson and go home licking your wounds but wiser. This guy's lawyers are going to cost him more than

there is nothing in your post that is correct with respect to B-J, except for the uneducated seller thing. They only sell no reserve, they forbid you from buying the car back, or having your agent do so. That is what their president said in his open letter regarding this matter anyway.

shoot... I have to agree that the BJ auctions are something of a pissing contest among the rich and infamous when it comes to the sale prices of the car....

However, if someone is stupid enough to sell their car at no reserve then such is life. I realize that 300K for a hemi cuda is somehow cheap in todays world but I can remember when they were 70K and people were falling over at the rediculous price guess I might be dating myself with that comment.

I wish that whole portion of the car world would go away. It really puts the cars into museums and climate controled environments and out of the hands of the people who would enjoy them for their initial intended purpose ... I always wanted an early corvette but the resto mania perfection cars have put them into the stratosphere for prices.

I am assuming that this particular car is related to the Scottsdale auction? If thats the case then the no reserve thing is fine, but not all of their auctions are no reserve. Quite a few cars at their West Palm Beach auction are reserve, but it doesnt make for good TV so you never see them

I would think BJ would have learned that they are going to make money hand over fist anyways, so why try to cheat the system?? Just like all the myth's about casinos pumping oxygen into the gaming floors to keep people up...their best argument to why that would never happen is the downside is so huge compared to what little return they might get from doing it. Casinos make a TON of money just opening their doors!

Well Tobra, I guess then that Bob Varsha and the other commentators on the Speed channel program which covers the BJ auction were all lying when they said that a seller can bid on their own car.
