This guys name is exactly as it implies. He wants to sell his CD for $1.00 but then charge an outragous amount for shipping. I have sent 2 CD's in the mail to all over the country and it costs about $2.35 to do it. I hate when people gouge for shipping.

a lot of sellers are doing this on purpose these days, since ebay cannot collect fees on shipping, they sell the item for nothing and charge it all into shipping so the fee is smaller. makes the seller look bad and isnt worth it if you ask me.
Chris H.
That manual would probably cost less than $1 to ship USPS first class mail.
boxstr
Suggest to the seller that you will send him a self addressed stamped envelope for him to send you the item in.

with anything I buy, I add handling and shipping into the eqaution on whether or not it's a good deal....I just bought an item for $5...I knew the shipping was a flat $15 fee, to me it was still a good deal

If this is a way to get over on eBay, then eBay should be complaining and not you guy's.

Nothing wrong with the seller trying to make money, eBay is not for people trying to give crap away and find the most economical shipping method. If this guy does not sell any CD's with this high shipping/handleing charge, then he'll have to lower it.....

end of rant smile.gif
Eddie Williams
It's also an attempt to recoup PayPal fees.
anthony
He wants $15 for the manual including shipping, what's the problem? If shipping was $2 the item was sell for higher.
Hawktel
I expect that Ebay will someday move to where they charge for the total, including the shipping.

But either way, its Ebays issue, not mine.
Dave Blackburn
Get this.
I have been dealing with this guy this morning who is threatening to sue me for negative feedback I left for him.
I won a CD burner for $11.00. His add says "buyer pays for shipping outside the us". I sent him $25.00 based on a $13.40 shipping quote from fedex which I e-mailed him and he agreed on. 5 days later I get a refund minus paypal fees and the item is now "broken".
I left feedback saying "backed out of sale. Cost me paypal fees. I paid $ for nothing".
He then refunded my paypal fees 15 DAYS later and I get this E-mail:

Dear Mr. Blackburn:

Please be advised that unless you withdraw your complaint, I will instruct my Canadian attorneys to file suit against you in Calgary for malacious and wrongful defamation.Unless, this inaccurate complaint is removed, I also intend to file a formal complaint with Ebay. The fact is you won the bid on the CDRW with a winning bid of $11. The item clearly stated that shipping was an additional $20 for a total of $31. You paid $25 which is less than was agreed. The item was not working properly so I returned your money. You complained that I did not refund your $1.48 Paypal fee. I then paid you $2.00.

Please be advised that Ebay is a hobby for me, not a business. However, I am prepared to devote considerable resources to clearing my reputation.

Check it out.
What a f*cking joke.

Dave
seanery
Dave,

He's got no leg to stand on if you kept the two way communication between the two of you.
I would forward it all to ebay.
Scott Carlberg
Dave,
have you thought about sending this guy a reply/email back........

finger.gif stfu.gif pissoff.gif bs.gif chair.gif

just wondering lol2.gif
Dave Blackburn
I sent him about 4 replies.
He is now going to remove his feedback.
Here is another e-mail I got from him:

You have jumped to a series of conclusions that are just wrong. I am a
wealthy person and this is just a hobby for me. My record on Ebay is
beyond reproach and I will not allow you to spoil it. I am willing to
spend thousands to get justice

WTF?!?!

Dave
Mueller
With remarks like that, I'd view this as intimidation....how would the courts like that????
Dave Blackburn
The feedback he left me:

"Do not sell to this person. He is not honest and does not communicate"

The feedback I left him:

"Poor comm. Backed out and cost me paypal fee's. I ended up paying $ for nothing"

Another e-mail:

It's simple, I will remove my negative feedback if you take yours off.
Will take the first step and remove my negative feedback. My attorney
says I have acted fully incompliance with the terms of Ebay and that
your feedback constitutes "deliberately malicious" actions

WTF? deliberately malicious actions?!?!
Come on. Get a f*ckin' life.
The feedback I left him is the truth. He refunded me $25.00 and backed out of the sale after 5 days saying the item was "broken". Paypal charged me $1.50 or something.
He sent me $2.00 15 days later along with the "I'm going to sue you e-mail".
I consider myself honest and I sent him about 4 emails before I sent the payment. I got simple one word responces.
Man, some people!!! finger.gif finger.gif finger.gif
biosurfer1
i wouldnt worry about it, this guy not only doesnt have a case, i doubt he if he even has a lawyer. on top of that, i dont think you can remove negative feedback once its left.
seanery
Dave,

I had a guy try to do this whole thing with me, but it was slightly different. I sold some tires of my vette that had been in my garage since 95. I took several pictures of them. They were listed as "for a show car." I was very forthright about the condition, etc... Well this dickweed got them and before he contacted me he left feedback that said I sold him tires with a hole in them (I think he spelled hole wrong, too). I told him if there was a hole, then he should contact UPS because there wasn't a hole in them. Well, he says there was a hole, but it was plugged. WTF! I checked 'em out pretty good, I didn't see a hole, but I used them and the worked perfectly fine, which is why I kept 'em. He threatened to sick Ebay, the Nevada Attorney General & the Indiana Attorney General on me for Fraud. Eventually Ebay found in my favor, but damn, what a pain in the ass he was. I got shitty letters like the one you got. In the beginning I was willing to take 'em back, but he was such a weaseldick that I basically said F.U.!

Good luck, it'll get better. He doesn't have a case.
skline
Negative feedback can only be removed under special circumstances and Ebay decides what that is per case. If it was only a week old and works perfect like his auction said, then he did back out of the transaction and got what he deserved. If he is so rich, then why did he sweat the small crapola money and refund you the money you spent and not just send you the drive you purchased? This guy is tugging on his dick with both fingers from each hand. I would not even reply to him anymore.
ss6
Welcome to "retail". E-bay exposes you to a very wide spectrum of humanity (thankfully limited to the internet enabled subset), including A, those who "are off their meds", and B, those who need meds but don't know it yet. Be thankful you're not a "stationary target" shop owner who has to endure this kind of stuff face to face.

On the very slim chance your particular space cadet has money to piss away on legal harassment, describe your situation to Ebay and ask their guidance as an individual who wants to "do the right thing". They have a lot more experience with this crap (and more lawyers); following their guidance would make them an "800 lb gorilla" buffer between you and said space cadet in any actual litigation.

PS - This guy has obviously scanned and copied a Porsche owner's manual. If there is any copyright notice anywhere in said manual, the guy has a bulls-eye on his forehead to begin with ar15.gif
GWN7
Dave,

hope he has deep pockets. First he would have to hire an attorney to sue you in MA. Then one in Texas, where ebay is corporately registered. Then another in Alberta. As these are the three legal arenas he will have to cover to to prove "deliberately malicious" actions. As he deliberately posted false comments and then demanded that you remove yours you could counter sue him as part of your responce to any suit he might bring.

Tell him any further communication should be directed to your attorneys Dooey, Screwum and Howe at your P.O. Box #

You will never hear from him again. laugh.gif

You should read the "legal" advise on this site and the threats he received and his "attorneys" responces.HERE Good for a grin. smile.gif
seanery
damn bruce, that's funny shit.
GWN7
Yep laugh.gif

Leonard Crabs, the "lawyers" bio is almost as funny HERE smile.gif
anthony
As other have said you can't remove feedback. He could pay $25 and join Square Trade and get it removed that way.

Also, why were you charged a Paypal fee for purchasing something. That doesn't make sense. Only the seller should be charged a Paypal fee.
seanery
Anthony,
I think he was charged when the paypal $ was returned to him. That's when the fees would come out.
rhodyguy
he's a "wealthy" person selling stuff on ebay for a hobby? if i were a wealthy person my hobby would be collecting first class frequent flier miles. why would you want an owners manual on a dvd anyway?

kevin
seanery
Here's a LINK to my asshole guy. I love to see that he's been kicked off YET AGAIN!! It's the third time that I know of. laugh.gif
Dave Blackburn
Good stuff Bruce,
I got charged paypal fees when he returned my money to me because the item was now "broken".
What an assh*le.
Oh well, you know those wealthy people, so much injustice.......time somebody spoke up!
Anyone know of any good gayporn mailing lists to sign him up to? wink.gif
Come on, anyone?

A quick search provided THIS LIST of items.

I sent this Ebay seller an email before bidding on one of their items, also here is the reply I got. and the one I sent back.
To seller:
Your shipping seems a little high for being local. Would you consider lowering the shipping costs? I live in Orange county.

Let me know,
Scott

Yeh,
I hate when I see a good deal and shipping will be $24.99 or something.
This guy said "I have to get a box, drive to ups store and park" sad.gif

So seanery, which one is your favorite? wink.gif

My question is:

Does everyone think the seller should eat the 10$ worth of fees that Ebay and Paypal charge ? Or should the seller include them in the "shipping and handling" ??

I see what he is doing. All of us can do the same thing.

B
Dave Blackburn
I think that most the time I am getting screwed.
I am often looking on ebay and see some things (dvd player for example) that might be a good deal.
I then look at the shipping and handling and it will be $20 - $30.00.
Paypal fees and ebay fees are not more that $6 or $7 and I think that is the cost of doing buisness.
Shipping, unless the item is very heavy or large, is usually only less that $10.00 or so ground.

http://cgi.ebay.com/ws/eBayISAPI.dll?ViewI...&category=50599

That is one example.
I have got a few parcels to Canada after I paid $15 or $20 for shipping ant the shipping rate was on the package for $5 or $6.00.

Dave
Hawktel
If hes going to use the Shipping and Handling charge to alleviate his other fees he should note it in the listing of the Ad I think.

Call me a weary consumer but stupid Marketting gimmicks like this dont impress me. I doubt I'd purchuse from this guy, at any price. If he goes to this much effort to get out of some fees to Ebay, how hard is he going to work to screw me over?

Ebay and paypal fees can add up. They can add up to almost 9%. The seller has to pass this on the customer in one way or another - either a higher price or higher S&H.

I think complaining about shipping and handling is a waste of bandwidth here. It's the seller's auction and his rules. They have clearly stated their "shipped" price in this case. You either want it or you don't at that price. It's pointless to argue that the real shipping cost is less. Move on to the next auction with terms you like.

In this case does one really think that the shipper should sell this manual for a $1 and then ship for actual cost? He'd be getting less than $1 after fees for his manual. What's a reasonable price for a car manual?
Brad Roberts
The Ebay fees recently have jumped significantly...so has shipping...(screwing us during the holidays)

I dont condone what he is doing... but I also plan to bombard EBAY with 914 parts until I puke. I dont really care if any of the parts sell thru auction... but I will have to pay for everything I run, which means the price of the part will go up to cover the "advertising". Ebay (last time I checked) gets real pissy if you mention the "paypal" fees or "Ebay fees" in the ads. The way to get around this: include it in the shipping and handling.

B
Brad Roberts
Case in point with shipping (had nothing to do with Ebay or Paypal..just UPS)

A manufacturing company I know (LOL) has included 3-5$ on every single box shipped out for the last 20+ years (and nobody has complained). The reason: UPS charges 21$ a month to have every day pickup (5 days a week). Then UPS charges the shipper 8-10$ MORE if the address was incorrect in any way/shape/form (we are getting the address from a retailer..none of them check the address).. They also decide (UPS) when they need to impose a fuel surcharge to yor regular bill. All of this ads up.. why should the manufacturer eat it ?? The 3-5$ extra on every box doesnt always cover the money owed on shipping at the end of the month. It is a hassle dealing with all shipping companies.

Guys,

You think that's bad... my friend sold this car on eBay:

http://cgi.ebay.com/ebaymotors/ws/eBayISAP...item=2433268732

The buyer had it planned all along to defraud him... he purchased the vehicle insurance from ebay... later after he recieved the car (I think it was shipped to Texas), he told my friend that he's been ripped off, the engine is not original and a bunch of BS. My friend said he never claimed it's original and he never check the box that it's original mileage on pink slip.... Anyways... so he offered to refund him back the deposit of $400, if and only he left positive feedback, which he did, and said the deal is done, just to get rid of this guy.

Next thing you know, he's telling eBay he's been defrauded, wanted $1600 from eBay insurance. He told them the same, bs... that he didn't get the hard top, it's not original engine, smoke was coming out of the engine... Trust me, I know my friend wouldn't keep a f*cken hard top to a car he doesn't have any longer (I'm at his house at least once a week and I don't see a hard top laying around) and I was with him when we took the car to get smogged here in CA a couple weeks before he sold it on eBay. He was hoping to sell it local on craigslist but buyers are flaky on CL.

He threaten my friend w/ all this legal mumbo jumbo... eBay called and everything trying to get them two to settle it. But it was obvious this guy wasn't going away, calling his office, HR, home, etc. Well, my friend finally forwarded the e-mail to eBay saying how if the buyer got the deposit back that the deal is done. eBay must have squred it off with him and gave him another $200 from what I was told.

Anyways... EBAY SUCKS! It's obvious if he left positive feedback... then deal is done right... he came back trying to collect from my friend and eBay... what an A**HOLE! EBay just assumed my friend, who doesn't speak english that well, was guilty. How would it pass smog if he claims smoke was coming out of engine & exhaust and what's up w/ saying he didn't send the hard top.

Bottom line it's a $3300 car plus shipping... and the f*cken guy wanted it for free... there's premeditated thought there when he purchased insurance on a $3300 car...

I hate eBay nowadays... I've been screwed over more than once myself... both selling and buying...

I have gotten some good deals and met some nice people... but the times I got screwed over, left a bad taste in my mouth...

I just mailed a box. Weight app. 2 lbs.

Postage was $7.40 for ground shipment to the USA (10 day delivery).

Add the cost of the box I bought to ship $2.16 and if I wanted insurance on it, add another $2.55 (up to $100 value)

Total = $9.56 (without insurance)
$12.11 (with)

You want it to get there faster add a bunch more $$$

At least the guys on ebay that post the shipping charges are giving you a indication as to the costs. They could have just listed their items as "Buyer pays actually shipping costs" and then hit you with a $9.00 bill. sad.gif
biosurfer1
hey timecop...i just read that in order to get insurance from ebay, the car has to be a 1991 or newer?

and brad...the reason that ebay gets pissy when you mention the fees in the ad is that they have it in their user agreement that the fees are the responsibility of the seller and are not supposed to be passed onto the buyer, which i really dont see why that is...but anyhow, thats why...i've been selling on ebay for years and the costs of doing it has gone up so much since the beginning, almost to the point that it isnt worth it most of the time.
tracks914
I have found shipping to be easy. I just email the seller to give me an actual quote. I also look it up on US Postal web site. If it is close, I bid. If he won't give the quote or give me the item for the "actual shipping cost" then I just don't bid. All is up front and I don't get burned with it.
It's just EBAY and I only bid up to 2/3 of the new value including shipping. I don't bid on things I need, just things I want. If it is an item that I really need I will just go down town and buy it!
I also keep all my emails, just in case.
