This guys name is exactly as it implies. He wants to sell his CD for $1.00 but then charge an outragous amount for shipping. I have sent 2 CD's in the mail to all over the country and it costs about $2.35 to do it. I hate when people gouge for shipping.

a lot of sellers are doing this on purpose these days, since ebay cannot collect fees on shipping, they sell the item for nothing and charge it all into shipping so the fee is smaller. makes the seller look bad and isnt worth it if you ask me.

with anything I buy, I add handling and shipping into the eqaution on whether or not it's a good deal....I just bought an item for $5...I knew the shipping was a flat $15 fee, to me it was still a good deal
If this is a way to get over on eBay, then eBay should be complaining and not you guy's. Nothing wrong with the seller trying to make money, eBay is not for people trying to give crap away and find the most economical shipping method. He wants $15 for the manual including shipping, what's the problem? If shipping was $2 the item was sell for higher.

Get this.
I have been dealing with this guy this morning who is threatening to sue me for negative feedback I left for him. I won a CD burner for $11.00. His add says "buyer pays for shipping outside the us". I sent him $25.00 based on a $13.40 shipping quote from fedex which I e-mailed him and he agreed on. 5 days later I get a refund minus paypal fees and the item is now "broken". I left feedback saying "backed out of sale. Cost me paypal fees. I paid $ for nothing". He then refunded my paypal fees 15 DAYS later and I get this E-mail: Dear Mr. Blackburn: Please be advised that unless you withdraw your complaint, I will instruct my Canadian attorneys to file suit against you in Calgary for malacious and wrongful defamation.Unless, this inaccurate complaint is removed, I also intend to file a formal complaint with Ebay. The fact is you won the bid on the CDRW with a winning bid of $11. The item clearly stated that shipping was an additional $20 for a total of $31. You paid $25 which is less than was agreed. The item was not working properly so I returned your money. You complained that I did not refund your $1.48 Paypal fee. I then paid you $2.00. Please be advised that Ebay is a hobby for me, not a business. The feedback he left me:
"Do not sell to this person. He is not honest and does not communicate" The feedback I left him: "Poor comm. Backed out and cost me paypal fee's. I ended up paying $ for nothing" Another e-mail: It's simple, I will remove my negative feedback if you take yours off. Will take the first step and remove my negative feedback. My attorney says I have acted fully incompliance with the terms of Ebay and that your feedback constitutes "deliberately malicious" actions WTF? deliberately malicious actions?!?! Come on. Get a f*ckin' life. The feedback I left him is the truth. He refunded me $25.00 and backed out of the sale after 5 days saying the item was "broken". Paypal charged me $1.50 or something. He sent me $2.00 15 days later along with the "I'm going to sue you e-mail". I consider myself honest and I sent him about 4 emails before I sent the payment. I got simple one word responces. i wouldnt worry about it, this guy not only doesnt have a case, i doubt he if he even has a lawyer. on top of that, i dont think you can remove negative feedback once its left.

I had a guy try to do this whole thing with me, but it was slightly different. I sold some tires of my vette that had been in my garage since 95. I took several pictures of them. They were listed as "for a show car." I was very forthright about the condition, etc... Well this dickweed got them and before he contacted me he left feedback that said I sold him tires with a hole in them (I think he spelled hole wrong, too). I told him if there was a hole, then he should contact UPS because there wasn't a hole in them. Well, he says there was a hole, but it was plugged. WTF! I checked 'em out pretty good, I didn't see a hole, but I used them and the worked perfectly fine, which is why I kept 'em. He threatened to sick Ebay, the Nevada Attorney General & the Indiana Attorney General on me for Fraud. Eventually Ebay found in my favor, but damn, what a pain in the ass he was. I got shitty letters like the one you got. In the beginning I was willing to take 'em back, but he was such a weaseldick that I basically said F.U.! Good luck, it'll get better. He doesn't have a case. |

Negative feedback can only be removed under special circumstances and Ebay decides what that is per case. If it was only a week old and works perfect like his auction said, then he did back out of the transaction and got what he deserved. If he is so rich, then why did he sweat the small crapola money and refund you the money you spent and not just send you the drive you purchased? This guy is tugging on his dick with both fingers from each hand. I would not even reply to him anymore.

Welcome to "retail". E-bay exposes you to a very wide spectrum of humanity (thankfully limited to the internet enabled subset), including A, those who "are off their meds", and B, those who need meds but don't know it yet. Be thankful you're not a "stationary target" shop owner who has to endure this kind of stuff face to face.
On the very slim chance your particular space cadet has money to piss away on legal harassment, describe your situation to Ebay and ask their guidance as an individual who wants to "do the right thing". They have a lot more experience with this crap (and more lawyers); following their guidance would make them an "800 lb gorilla" buffer between you and said space cadet in any actual litigation. PS - This guy has obviously scanned and copied a Porsche owner's manual. If there is any copyright notice anywhere in said manual, the guy has a bulls-eye on his forehead to begin with (IMG:style_emoticons/default/ar15.gif) |

hope he has deep pockets. First he would have to hire an attorney to sue you in MA. Then one in Texas, where ebay is corporately registered. Then another in Alberta. As these are the three legal arenas he will have to cover to to prove "deliberately malicious" actions. As he deliberately posted false comments and then demanded that you remove yours you could counter sue him as part of your responce to any suit he might bring. Tell him any further communication should be directed to your attorneys Dooey, Screwum and Howe at your P.O. Box # You will never hear from him again.
