Since there was a "legal" agreement to share the content, and considering that the content is owned by the sites, I dont think you can actually legally demand to have it removed. That's incorrect, yes you can. [ Is the content here owned by the site? Who or whom is the site? I was under the impression that all the informtion contained on this site, was free and accessable by all, and owned by none. Is that the case? An author always owns the content of what they write. Even when you post on the internet- you have an automatic copyright of your own material- assuming that it's your own words and ideas. good question dan. i thought my threads were mine. and i WAS free to delete anything I put into this site or any other site. as well as my posts to other threads. because they are MY posts and threads. as well as i did not sign my rights over to anyone to control MY content. Exactly- the ONLY way you could lose your implicit copyright of something you wrote is if you actually sign your rights away on an actual piece of paper. And that raises other issues- if the person/company you 'sign' your rights away to intends to make money from your writings- you are still entitled to be 'reasonably compensated' (IMG:style_emoticons/default/biggrin.gif) Interesting question: who owns what is posted? Know a little about this, wife has been in publishing (magazine and web) for over 20 years. Generally once you post in a forum like this, it goes into the public domain UNLESS you copy right it. I no longer want to be associated with the 914club dot com site or it's administrator/owner, but am unable to edit my past posts (on his site). Brad does not 'own' the content on his site. He own's a domain name, an LLC, and a logo. Even if he put a notice at the top of the page saying that he 'owned' whatever you wrote- that still would not legally cut it. He must obtain your written signature. You have options, John. You can mail Brad a 'Cease and Desist' letter stating that you do not want him to continue using your posts. Then you sign it. Then he is legally obligated to remove your postings. A similar thing could even be done with a group letter that contains everyones signature. (IMG:style_emoticons/default/happy11.gif) But it must all be done on real paper to be legally binding. Certified mail doesn't hurt either. Everyone seems to have different idea's about 'who owns what'. Copyright is pretty simple. It has worked well for authors, artists, song writers, ect., for many years. The internet is a slightly different animal because you are submitting your material into the public domain, true. But that still does not remove your implicit rights of ownership and copyright on your own original material. I'm not saying anyone should remove anything... I just think all this confusion around the issue is rather distracting and leads to arguments. |

As a rookie I would like to know that there is a 914 site that doesn't have sooooooooooooo mmuuuuuucccccch drama. Well, there's the Pelican and Roadglue sites. Their forums don't have anywhere near this much drama. The downside is they are not nearly as active... An author always owns the content of what they write. Even when you post on the internet- you have an automatic copyright of your own material- assuming that it's your own words and ideas. My understanding on this subject matches yours. You always own the rights to your own thoughts, ideas, and words. When you post on a forum, you do not lose that right, nor grant someone else ownership or co-ownership. You do implicitly grant someone a license to duplicate the ideas and distribute them... But the exact question of "who" and "to what end" is not something that always has a very straightforward answer. --DD |
