I just messaged Jim on Facebook and gave him my address. He is finishing polishing now that he is out of the Hospital.

Jim is a stand up guy with some serious health problems.

I suggest anyone waiting for an emblem email or PM him with your shipping address.

Jim is avoiding the World due to the stress it puts on him to get ridiculed publicly.

He says he has some shipping addresses for the previous orders. Please send him an update about your order. Do not get mad if you do not receive a response.

Jim has spent much of his time in the hospital over the last few years. This is why he sold the business to Carrie. Tim sent all the emblems to Jim. He has them and is polishing away. As soon as they are ready, he will ship.

Jim contacted me, the radio silence has been broken! Due to the storms today, his internet connection is marginal at best. He sent me some pics via text, and wanted me to post these pictures on his behalf of his progress. The light at the end of the tunnel is getting much brighter!

My completely unprofessional opinion, just because I can.


I fail to understand how Tim or his uncle has violated any non compete clause. Tim signed no such agreement. A&P stated they would not make good on the promise to produce the items. Deal over and done.

Tim made no monetary gains from the manfacture of items. The profit (if any) was made by Jim long before the sale of his company. Jim is responsible for the emblems or return of the money, unless that debt was included in the sale.

I'm willing to bet that there is no patent or copyrights held on producing the emblems by anyone here. Therefore, Tim, or I, or anyone else who desires to manufacture the emblems can do so and compete directly.

Carrie, I think you may have shit in your own nest here big time.

Yes, I agree. The non compete clause in a contract involves no other party not named. Usually such a clause is for a specific period of time,. Also , some harm would have to result from the action. In this case, the outcome of producing the long awaited order is beneficial to everyone involved.

Just a bit of a detour off the topic of emblems. In the background of the picture, under the emblems that Jim is polishing, you see what he now does...
In between hospital trips and when he feels well enough, he makes 3D puzzles for kids. My kids are too old but if any of you have younger kids, these things are amazing... Huge dinosaurs, all kinds of other cool stuff.

I know Jim & met Tim when I was in Notre Dame recently. This came up over dinner just wondering if I knew Jim. I know him well but hadn't been in touch with him for a while. Guy has had some serious health & personal issues. Been a rough couple years to say the least. That doesn't give him a free pass in regards to people not getting their product. We are a forgiving & helpful group. While some of us might kick a guy when he's down in jest. I don't know many who would take a dump on the guy. I consider Jim a friend. I am not worried about any money I might be out for any product or service. He did my website for me. I just hope he get's to feeling better & can feel welcome on our forum again without the stress.

It was very kind of Tim to step up to the plate & help out. He did not want this public. It was supposed to happen behind closed doors. He just hadn't heard from Jim after shipping him the emblems. Tim's a straight up stud helping out many fellow teeners. His intent was never anything but helping get this done & over with. I've got nothing bad to say about A & P girl. I wish her the best with her business. Might be worth talking to Tim in a professional way. He's a stand up guy who would certainly accept your call.

Let's get all this negativity out of a thread that is a benefit to us all (IMG:style_emoticons/default/confused24.gif)
